What is Personal Data?

Under the KVKK, personal data refers to any information relating to an identified or identifiable natural person (“Personal Data”). A special category of personal data, referred to as Special Categories of Personal Data, includes data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data (“Special Categories of Personal Data”). The explanations provided in this Clarification Text regarding your Personal Data also cover your Special Categories of Personal Data.

By Which Methods and Legal Grounds Do We Collect Your Personal Data?
In all personal data processing activities we conduct, we act in compliance with the KVKK and all relevant legislation and take the necessary security measures to ensure that your Personal Data is processed securely. In accordance with the KVKK, we collect your Personal Data through the channels listed below, as well as through other channels that may be added in the future, by automatic or non-automatic means, verbally, in writing, or electronically, and process them pursuant to Articles 5.1, 5.2, 6.2, and 6.3 of the KVKK depending on the purpose of processing:

Through our websites where personal data are processed, primarily those related to the Yüksek İşler Brands mentioned in Annex 1 (“Yüksek İşler Brands”) (which may be updated from time to time under this Clarification Text), and other websites managed by Yüksek İşler (High Works) or Yüksek İşler Group Companies (“Websites”), our mobile and other applications and all other online platforms belonging to a Yüksek İşler Group Company (“Media Channels”), or via cookies belonging to Yüksek İşler (High Works) or third parties as specified below (“Cookies”),

• Through all sales and marketing networks established or operated by Yüksek İşler (High Works) and managed under the name of Yüksek İşler Brands (“Yüksek İşler Stores”) within the scope of sales and marketing activities,
• Through accounts operated on various social media platforms on behalf of Yüksek İşler (High Works) and Yüksek İşler Brands (“Social Media”),
• Through correspondence conducted via our email addresses (“Email”), short messages (“SMS”), multimedia messages (“MMS”) sent for various purposes related to Yüksek İşler (High Works) and Yüksek İşler Brands, and all other communication tools (“Communication Tools”),
• Through our call centers (“Call Center”) managed by Yüksek İşler (High Works) or service providers acting on its behalf,
• Through third parties such as group companies served by or providing services to Yüksek İşler (High Works), business partners, manufacturers, or companies supplying services/products.

Which Personal Data Do We Process?
Examples of the Personal Data we process include the following:

Personal Data You Provide to Us:
Name-surname, date of birth, Turkish ID number, phone number, email address, address, photographs and video recordings submitted within the scope of surveys and competitions, and any other Personal Data you share with us through the above-mentioned channels.

Other Information Including Personal Data Collected Automatically:
Personal Data collected automatically through search engines, audio and video recording devices, Cookies, or other means.

Other Information Including Personal Data Obtained from Other Sources:
Updated delivery and address information shared with us by social media platforms, business partners, suppliers, and other third parties based on your prior consent; account information; purchase and page view information; searched terms and search results; paid listings (such as Sponsored Links); and similar Personal Data.

For What Purposes Do We Process Your Personal Data?

As a rule, we process your Personal Data based on your explicit consent. However, in cases permitted under the KVKK (Articles 5.2 and 6.3), your Personal Data may be processed without your explicit consent. In this context, we may process your Personal Data (i) to fulfill our legal obligations, (ii) where you are unable to express your consent due to factual impossibility, (iii) for the establishment or performance of a contract such as providing products and services ordered or purchased through the Websites, carrying out purchase transactions at Yüksek İşler Stores, POS usage, return transactions, transportation services, establishment of distance sales contracts within the scope of e-commerce, sale, supply and delivery of products or services, receiving and responding to your questions and complaints, and using such data in case of possible disputes, or (iv) to protect our legitimate interests such as cost reduction, efficient use of resources, and monitoring call center service quality, provided that your fundamental rights and freedoms are not harmed. Additionally, Personal Data that you have made public through competitions or Social Media channels may also be processed within the limits permitted by the KVKK without seeking further consent.

Your Personal Data collected through the above-mentioned channels may, upon obtaining your explicit consent (Articles 5.1 and 6.2 of the KVKK), be processed for purposes such as: (i) online advertising, targeting and re-targeting, cross-selling, campaigns, special offers, and personalized product/service promotions, including the use of Cookies and making commercial offers based on your preferences and previous purchases; (ii) determining how you became aware of our Websites, generating non-anonymous traffic statistics through unique user registration, enhancing your Website experience and functionality, recognizing you during your visit and providing personalized content, and tracking usage habits in Yüksek İşler Stores to offer tailored products; (iii) conducting sales and marketing activities including personalized advertisements, campaigns, advantages and CRM (Customer Relationship Management) activities; (iv) developing new product and service models; (v) sending electronic commercial communications (campaigns, newsletters, customer satisfaction surveys, product and service advertisements); (vi) sending gifts, promotions, and periodicals; (vii) conducting corporate communication activities and organizing and informing you about events and invitations. Your Special Categories of Personal Data may also be processed upon your explicit consent for the purposes specified in Article 5.2 of the KVKK and the purposes listed from (i) to (vii) above.

Within this scope, by granting your explicit consent in the relevant documents and fields where required, you may support us in providing you with better service.

How Long Do We Process Your Personal Data?

Your Personal Data will be processed in compliance with the KVKK and relevant legislation on the protection of personal data and for the periods required by applicable laws, and in any case as long as the legitimate purposes specified above continue to exist.

Transfer of Your Personal Data to Third Parties and/or Abroad
Your Personal Data may be transferred domestically and internationally (including primarily EU countries, the United States, the United Kingdom, OECD countries, India, China, and Russia) to third parties from whom we receive services such as storage, archiving, IT support (servers, hosting, software, cloud computing), security, and call center services; to Group Companies, business partners, suppliers, banks, financial institutions, legal and tax consultants, and other related parties and authorized public institutions and organizations, where necessary for the purposes described above that do not require your explicit consent.

Otherwise, your Personal Data may be transferred domestically and internationally to Group Companies and third parties providing marketing and sales support only upon obtaining your explicit consent. In addition, in the event of the sale of part or all of Yüksek İşler’s assets (including but not limited to brands, domain names, and other commercial enterprise elements), your Personal Data may be transferred to the acquiring natural or legal persons and their stakeholders, business partners, intermediaries, and consultants to the extent required by the transfer, may be processed by such third parties within the scope necessary for the transaction, and in the event of transfer, the acquiring party may continue to process your Personal Data as the data controller.

Your Rights Under the KVKK Regarding Your Personal Data and Our Support as Data Controller
Pursuant to Article 11 of the KVKK, by applying to Yüksek İşler (High Works), you have the right to:

Learn whether your Personal Data is processed,

• Request information if your Personal Data has been processed,
• Learn the purpose of processing and whether your Personal Data is used in accordance with such purpose,
• Know the third parties to whom your Personal Data has been transferred domestically or abroad,
• Request correction of incomplete or inaccurate Personal Data,
• Request deletion or destruction of your Personal Data if the reasons requiring its processing no longer exist,
• Request notification of correction, deletion, or destruction to third parties to whom your Personal Data has been transferred,
• Object to a result against you arising from the analysis of your Personal Data exclusively through automated systems,
• Request compensation if you suffer damage due to unlawful processing of your Personal Data,
